NV: Countdown To Legal Pot – Who Is Allowed To Sell Pot?

The Elko Daily Free Press is counting down the days until marijuana is legal in Nevada by answering questions concerning the law.

Q: Who is allowed to sell marijuana starting Jan. 1?

A: While people who are 21 and older will be able to legally possess an ounce or less of marijuana starting Jan. 1, dont expect any places to legally sell it at the beginning of the year.

The Department of Taxation has 12 months from Jan. 1, 2017, to be ready to receive applications for marijuana establishments. Once the Department begins receiving those applications, it will only accept them from places holding medical marijuana establishment certificates for the first 18 months.

After that other people will be able to apply.

Elko County can have up to two marijuana retail establishments.

Everyone who applies for a retail license must pay a one-time application fee of $5,000. The Department also will charge a fee of up to $20,000 for the initial issuance of a license for a retail marijuana store and an annual renewal license of $6,600.

The initial license for a cultivation facility will be up to $30,000 with an annual renewal license costing $10,000.

Once the marijuana retail establishments are running, people will only need a photo ID to buy weed.

While these retail establishments wont appear Jan. 1, if Nevada follows in the footsteps of Oregon, you may be able to purchase weed from a medical marijuana facility.

Residents in Oregon were able to possess marijuana legally, but no recreational shops had opened. Months after the law passed, Oregon residents were able to purchase weed from medicinal shops until recreational dispensaries opened, according to Las Vegas Releaf.

"Nevada is expected to follow the same path as Oregon, but this has not yet been approved," stated Las Vegas Releaf. "Until then, Nevada residents wont have any place to purchase marijuana, although it will still be legal to possess and consume on private property."

If people have pot in Nevada, they are allowed to give an ounce or less to anyone 21 or older. However, they may not sell the drug to anyone. Also, if people give the drug to someone they dont know, it would be in their best interest to ask the stranger for identification first, so they dont unknowingly give it to someone who is underage.
